Aerial imagery downloaded via the tile-server royalty free?
Does anyone know if aerial imagery downloaded via the tile-server can be used to create photo realistic scenery which can then be made available to the public as freeware or is it for personal use only?

I am not a lawyer, but up to now I have not heard of any instance where Google or another map server has gone after freeware developers. And there has been a lot of scenery made with these aeriel images over the last decade.
So, you probably need not worry.

I think Luis is right and you're safe, but I'd double check this.
